During the pre-legal recovery process, our automated workflow sends out SMS and email notifications to account holders or parents, lists the debtors with the credit bureau, or hands the account over to your legal team. The legal route involves the summons of the defaulting party, judgement, and execution steps, where property may be sold in execution. If the breach is not corrected, the contract may be subject to cancellation. For private schools the primary action is sending a breach letter to address the arrears and warn of potential contract cancellation if the issue is not resolved. Schools can also issue a Section 129 legal notice or have their legal team send it when the account is handed over for collection. If the contract includes an acceleration clause, this should be incorporated into the collection workflow. If this notice is not sent, the account cannot be handed over to a legal team for collection.
